Výzva zahraničným veriteľom na prihlásenie pohľadávok Invitation to lodge a claim for foreign creditors V súlade s nariadením Európskeho parlamentu a Rady /EÚ/ č. 2015/848 zo dňa 20.05.2015, ako správca dlžníka Linda Šimková, nar. 6.3.1985, bytom Mesto Martin, 03601 Martin (ďalej len „dlžník“) oznamujem, že uznesením Okresného súdu Žilina, spis. zn.: 1OdK/51/2026 bol vyhlásený konkurz na majetok dlžníka. According to the Direction of the European Parlament and Council No. 2015/848 dated 20th May 2015, as the bankruptcy trustee of the debtor Linda Šimková, date of birth 6.3.1985, residency at Mesto Martin, 03601Martin (hereinafter only “the Debtor“), my duty is to inform that by the resolution of the District Court Žilina, No. 1OdK/51/2026, the bankruptcy was declared on the Debtor‘s estate. Toto uznesenie Okresného súdu Žilina bolo zverejnené v REPLIKU dňa 30.7.2026. Dňom 30.7.2026 bol vyhlásený konkurz na majetok dlžníka. This resolution of the District Court Žilina was published in REPLIK on 30th of Jul 2026. Bankruptcy was declared on 30th of Jul 2026. Vyhlásením konkurzu sa začína konkurz. Konkurz sa považuje za vyhlásený zverejnením uznesenia o vyhlásení konkurzu v pričom za deň zverejnenia (doručenia) súdneho rozhodnutia sa považuje nasledujúci deň po zverejnení súdneho rozhodnutia . Vyhlásením konkurzu sa dlžník stáva úpadcom (§ 167a ods. 3 zákona č. 7/2005 Z. z. o konkurze a reštrukturalizácií v znení neskorších predpisov a § 199 ods. 9 zákona č. 7/2005 Z. z. o konkurze a reštrukturalizácií v znení neskorších predpisov). The bankruptcy begins by declaring the bankruptcy. The bankruptcy is considered as declared by publishing the resolution on declaring the bankruptcy , whereby as the day of publishing (delivery) of the judicial decision the day following the day after the publishing of the judicial decision in the Commercial report shall be considered (§ 167a sec. 3 Act no. 7/2005 Coll. on Bankruptcy and Restructuring and § 199 sec. 9 Act no. 7/2005 Coll. on Bankruptcy and Restructuring). V zmysle zákona č. 7/2005 Z. z. o konkurze a reštrukturalizácii (ďalej len „ZKR") veritelia Dlžníka sú povinní v lehote 45 dní od vyhlásenia konkurzu prihlásiť svoje pohľadávky voči dlžníkovi v jednom rovnopise u správcu na adresu Ing. Tibor Bátory, správca, Andreja Kmeťa 19, 010 01 Žilina, Slovenská republika, alebo elektronicky do jeho elektronickej schránky prostredníctvom na to určeného elektronického formulára. Elektronické podanie a jeho prílohy musia byť podpísané zaručeným elektronickým podpisom osoby oprávnenej na podanie elektronického podania. Under the Act no. 7/2005 Coll. on Bankruptcy and Restructuring (the "Act on Bankruptcy and Restructuring hereinafter only BRA") the creditors of the debtor are required within the deadline of 45 days from the permission of bankruptcy to lodge their claims against the Debtor in one counterpart with the trustee to the address: Ing. Tibor Bátory, správca, Andreja Kmeťa 19, 010 01 Žilina, Slovak Republic or electronically to his online mailbox using appropriate application form. The electronic filling and its supplements have to be signed by the qualified electronic signature of person witch is authorized for submission of electronic filling.
